摘要
死刑的严厉性、死刑案件诉讼程序的复杂性决定了死刑案件律师辩护的特殊性和重要性。为死刑案件被告人辩护的律师除要承受着来自被告人及其亲属的巨大压力外,还承受着巨大的社会压力。我国死刑案件中律师辩护不论在立法方面、司法方面还是律师素质方面均存在着一些问题,必须努力提高死刑案件律师辩护的质量和效果。
The sternness of death penalty and the complicacy of contentious procedure in capital case determines the particularity and importance of a lawyer's pleading in capital case. The lawyer who pleads for the accused in capital case bears great social pressure as well as the great pressure from the accused and his relatives,The lawyer's pleading in capital case of our country has some problems whether in legislation,judicature or in the lawyer's quality,we must try to enhance the quality and the effect of a lawyer's pleading in capital case.
