在步入知识经济时代的当今世界,商业秘密对国别经济增长的贡献率,以及对商业竞争的影响力,尤其是其所固有的秘密性易于侵犯与难以管理的特性,相关的法律保护成为中美两国继确立传统知识产权制度之后又一立法热点,进而形成了各具特色的保护制度。比较中美保护商业秘密的立法与实践,有助于考察和展现两国现行机制及整体构架。

Protection of trade secrets has become an international issue seen from world scope. Relational international organizations and international pacts attach great importance to the trade secrets protection and have made out some regulations. According to these regulations, many countries and regions have enriched and consummated their laws on trade secret early or late in recent years. This article will introduce the legal system of trade secrets protection in China and America in a comparative view.
