试论宪政精神与宪政的神学基因

On the Spirit and the Theological Gene of Constitutionlism

以西方为蓝本构建宪政制度一直是非西方传统社会现代化过程中难以成功解决的问题。实际上,隐藏在西方宪政制度背后的是一套独特的文化机制,而其中又以从古希腊、罗马延续下来的法治传统和基督教神学思想为主要的支撑点。西方的文化浸润着基督教神学理念,由此培育了一种独特的以守法与自律为特征的宪政精神。这是一种文化机制,也是一种生存方式。如果不能同时移植西方文化的根基,宪政制度的建构将是很难行之有效。

The construction of constitutionalism based on the West always has been a problem, which can not be solved during the process of modernization in the non-West traditional society. In fact, there is a set of special cultural mechanism hidden behind the Western constitutionalism, in which the legal tradition and the theology spirit of the Christian religion dated back from ancient Greece and Rome are the key points. The culture of the West infiltrates a special constitutionalism characterized by law-abiding and autonomy . This is a living way as well as a cultural mechanism. The construction of constitutionalism will not take effect unless the basis of Western culture is transplanted at the same time.
