西方主要国家侵犯著作权犯罪种类论析——兼谈我国侵犯著作权犯罪的立法完善

An analysis on the kinds of crimes of infringing copyrights in western countries—— Also talking about the perfection of legislation of infringing copyrights in China

西方各主要国家侵犯著作权犯罪种类繁多、法网严密 ,过多的侵犯著作权犯罪规定不利于著作权保护的利益平衡 ,但西方著作权犯罪立法仍然有值得我国借鉴之处 ,我国侵犯著作权犯罪的种类需要在保护著作权利益平衡基础上结合我国国情适当地增加和完善。

In most western countries,there are many kinds of crimes of infringing copyrights.Too many criminations on actions of infringing copyrights will break the balance in copyright protecting.Although there are many limitations in western countries’legislation of infringing copyright crimes, but there is still something we can learn from the western countries’relating crimes to consummate legislation of infringing copyright crimes in our country.
