从各国较为成熟的反垄断法来看,具有雄厚经济实力进而握有市场力量的大企业集团始终是反垄断法关注的对象。而中国长期以来对是否要制定反垄断法一直存在争论,反对者的一个强有力的理由就是反垄断法的出台将阻碍中国企业集团的发展壮大。从企业集团自身的性质和反垄断法的立法宗旨与制度设计两方面讨论企业集团与反垄断法的关系。

The relationship between the enterprise group and countermonopoly law lies in the fact the seen from riper countermonopoly law of each country, big enterprise groups with abundant economic power and with great market force are always objects for countermonopoly law. But in our country there has long been argument whether a countermonopoly law should be made. The strong reason from opposers is the making of a countermonopoly law will hinder the development of an enterprise group in our country. The article deals with the relationship between enterprise groups and countermonopoly law from two aspects:one is its character of an enterprise group; the other is legislative aim and system design of the countermonopoly law.
