简论我国对行政自由裁量权的规制

Brief Discussion to Control and Supervise Discretion of Agency

行政自由裁量权是国家行政权存在运行的一种普遍方式 ,也是国家行政机关在行政执法中的一项重要权力。目前我国行政自由裁量权在立法上的一些缺陷必须从行政程序、立法、司法方面进行规制。

discretion is very important power for agency to put into practice,at present the author think there are still some legal defect in discretion,so the authority should control and supervise the exercise of the discretion,should strengthen making-lat to supervision discretion in administation procedure act and judicial review aspect and so on.
