摘要
随着我国房地产业的蓬勃发展 ,预售商品房转让 ,已成为一种普遍现象。现实中 ,大量存在预售商品房转让合同纠纷。通过探讨预售商品房转让行为的法律性质 ,得出预售商品房转让行为为债权行为 。
With the rapid development of China’s real estate industry, the transfer of pre-sold commercial residence houses has become a universal phenomenon. In reality, there have existed a large number of contract disputes arising from the transfer of pre-sold commercial residence houses. In this paper, by discussing the legal nature of the transferring behavior of pre-sold commercial residence houses, it is found that the transfer of pre-sold commercial residence houses is a claiming behavior, aiming to solve some complicated real estate disputes.
