浅析民族自治地方的立法权限

立法权限是立法机关实施立法行为的基础。从宪法、民族区域自治法和立法法的有关条款及立法精神来看,民族自治地方的立法机关享有广泛的立法职权,可以制定实施性法规、自主性法规和变通性法规。同时,还可依法律授权而享有委任立法权。但是,有关授权立法的规定与民族自治机关的立法职权相冲突,亟需统一规范。

Legislative competence is the foundation of legislative institution enforcing legitimate act. From the perspective of institution, law of regional national autonomy and legislative law, legislative institution of national autonomous areas enjoys great legislative power and delegated legislation power. However, the regulations of authorized legislation conflict with the legislative competence of national autonomous institution, which should be regulated.
