摘要 我国公务员惩戒制度存在的问题从总体上讲是粗疏简陋、适应性差,其原因主要有法律制度本身和法律文化两方面。因此,解决问题的对策主要是以宪法的人权保障规范为依据,从惩戒的事由、种类、适用对象、机构、决定程序、适用标准、适用的法定和酌定情节、追究时效和惩戒执行与救济等方面在制度上予以完善,建立起科学的公务员惩戒制度。 With regard to the questions existing in the punishing system for the government functionaries, generally they are barbaric and simple and less adaptable. The reasons mainly are in the legal system itself and the legal culture. So that the counter measures for solving such questions are: according to the constitutional human right guarding norm, perfect the measures for the systems of such respects as the reasons, kinds, suitable objects, structure, decisive program, suitable standard, suitably legal and discretionary circumstances, investigating prescription , carrying out punishment and relief and build up scientific punishment system for government functionaries.
