环境责任“原罪”说——关于环境无过错归责原则合理性的再思考

The Viewpoint of Enviroment Liability"Original Sin" ——The Reflection On the Reasonable Ground of No-facult Liability Principle of Enviroment

关于环境侵权无过错归责原则合理性的解释,学术界作过反复探讨,但都没有给出无懈可击的论证。我们主张环境责任"原罪"说,即任何环境行为都负有妨碍环境的"原罪",环境侵权是由环境行为引发的对有归属利益的危害。环境侵权行为人只是环境行为人中的一部分,只有他们才成为环境侵权的受控者。

Although academic circles has put forword much interpretation on the reasonable ground of no-facult liability of tort of enviroment,but still has not given an unassailable demonstration to it.In this thesis,We hold the viewpoint of enviroment liability“original sin”,which stand for that every act of enviroment has “original sin”that pimpair enviroment,tort of enviroment is aroused by act of enviroment that damnify interests of being attributed.The actor of tort of enviroment is a part of actors of enviroment,only they could be accused for the act of tort.
