商业网发展的法制建设

The Legal Institutions Construction for the Development of Commercial Network

本文认为,我国商业网点盲目建设严重,流通领域无序竞争导致的诚信丧失、假冒伪劣等问题怵目惊心,其治本之策在于完善“游戏规则”和实施公正裁判,为商业网发展立法,使之走向法制化轨道。全国性的商业网立法要抓住重点,规定各大城市均须做5年或10年的商业网规划,并纳入城市总体规划之中,地方政府或人大常委会均应制定本市的商业网发展和管理条例,规定凡新建5000平方米以上的店铺均须举行有专家、同行、附近居民代表参加的听证会,必须有环保、居民安宁、停车位、交通条件等方面的专家论证报告;大中城市、城镇的商业网规划及其实际建设必须符合本市、本镇总体规划的要求,实用、美观,成为“百年大计”的主要构成部分。现商业网发展立法已提上议事日程,应尽快进入立法程序。

It is an urgent task to formulate laws to solve problems such as blind constructions of our commercial network,trust loss caused by out-of-order competition in the distribution field,etc. In such laws, every big city must make five or ten years of commercial network plans attached to the general city plan. Local governments should make regulations regulating the management and development of commercial networks in their own city.Commercial network plans of big and middle cities and towns must meet the requirements of their own general plan both practical and beautiful.Commercial network laws should be put on the agenda.
