论隐私权的民法保护

On Protection of Civil law for Individual's Right to Privacy

民法保护是隐私权法律保护的一个薄弱环节,急需加强。常见的隐私侵权行为有非法获取、利用、传播他人隐私,以及非法侵扰他人私生活空间等。隐私侵权民事责任应坚持过错责任原则。停止侵害、赔礼道歉、赔偿损失为主要责任形式。目前,我国应当在立法、司法、法制教育等方面加强和完善隐私权的民法保护。

Civil law's protection is a weak link of jural protection for individual's privacy right. It needs strengthening eagerly. The usual torts against privacy are obtaining,using and spreading other's privacy illegally,aggressing and disturbing other's privale life,etc. The civil responsibility of violating other's privacy should adhere to the principle of error responsibility. The main pattens of responsibility are stopping violation,apology and paying for the loss. At present,the protection of civil law for privacy right needs strengthening and perfecting in aspects of legislation,justice and jural education.
