体育竞赛电视转播权跨国转让纠纷的救济途经

On the Solution to Transnational Transfer Dispute of the Television Broadcasting Right of Sports Games

世界各国对体育竞赛电视转播权与转让的界定以及法律保护的机制不完全一致,尤其是缺乏与体育竞赛电视转播权转让相关的国际公约,体育竞赛电视转播权跨国转让纠纷难以避免。现今解决这类纠纷的途径大致有三种:依靠体育协会章程的救济方式、依靠仲裁的救济方式和依靠司法诉讼的救济方式。我国有关部门应结合2008年奥运会的要求,在实践中尽快探寻有效措施来解决我国体育竞赛电视转播权跨国转让的纠纷或争议。

There are various definitions and legal protection systems in different countries, and especially, there is a lack of the international conventions relating to transfer of the television broadcasting right of the sports games. Thus, the dispute of transnational transfer concerning the television broadcasting right of the sports games is hard to be avoided. This paper expounds three solutions to the aforesaid disputes, including relief relying on the constitution of physical education association, relief relying on arbitration and relief relying on judicial action. In order to meet the demands of the 2008 Olympic Games, effective measures should be searched for!settling the disputes concerning the transnational transfer of the television broadcasting right of the sports games.
