摘要
擅自出卖、转让国有档案罪的主体是一般主体,客体是复杂客体。本罪的犯罪对象是国有档案,即国家拥有所有权的档案,并且仅指档案原件而不包括复制件。本罪在客观方面表现为违反档案法的规定,擅自出卖、转让国家所有的档案,情节严重的行为。对于抢夺、窃取国有档案后又擅自出卖、转让该档案的,应当按照抢夺、窃取国有档案罪从重处罚。
The main body of the crime of selling or transferring state-owned archives without permission is ordinary individual, but the object is a kind of complex object. The crime refers to the act of selling or transferring state-owned archives without permission. For those who seize by force or steal state-owned archives and sell or transfer these archives without permission, their conduct accords with the crime of seizing by force or stealing state-owned archives.
