《欧洲宪法》初探

An Initial Study of the “European Constitution”

本文从欧盟主体机构及其运作机制的重要变革、欧盟公民欧洲的建设与公民基本权利的保障 ,以及欧盟法律体系的整合与简化等 3个方面对长达 3 2 5页的《欧洲宪法》进行要点评述 ,认为这部宪法为欧洲联盟奠定了统一的法律基础 ,革新了欧盟现有的组织机构 ,并在建立一个自由、民主、透明、安全和公正的欧洲方面取得了重大进展 ,但从它正式问世到最后生效尚存许多变数 ,需要欧洲建设的政治家们和人民尽显勇气和智慧 。

The “European Constitution” was finally approved on the last day of the EU Ireland Summit on June 18, 2004. The author, in this article, will make comments on the 325-page constitution on three aspects: the important changes in the major sturctures and operational mechanism of the European Union, the construction of civic Europe and the guarantee of basic civil liberties of the EU, and the integration and simplification of the legal system of the EU. The author points out that the constitution lays a unified legal basis for the European Union, reforms the current organization structure of the EU and makes great progress in the builing of a free, democratic, transparent, safe and just Europe. However, there are still many uncertain factors between the birth of the constitution and its final going into effect, which calls for the wisdom and courage of statesmen working for the building of Europe and the people to meet the challenge.
