中国开放法律服务市场有关问题之探讨

中国已经加入了WTO ,根据世界贸易组织协议的内容 ,服务贸易总协定对中国适用 ,根据秘书处所制定的服务类别表的内容 ,法律服务属于专业服务 ,因此 ,中国应采取谈判的方式逐步开放其法律市场 ,使得外国律师能为我国的企业和公民提供服务。根据法律服务业的内容、实践中的贸易障碍类型 ,服务贸易国际化的趋势 ,是我国应正确对待的问题。

China has entered into WTO. According to the subjects of the agreements of WTO, GATS applies to China. On the ground of the subject of the services category table made by the Secretary Office, legal service is subject to professional service. Therefore, China should gradually open its legal market by using the way of negotiation to enable the foreign lawyers to provide service for the enterprises and citizens of China. According to the subject of legal service industry, the categories of trade barriers in practice, and the trend of service trade internationalization, China should treat them correctly.
