原创性——学术研究的基本准则

原创性是学术研究的基本准则 ,它源于学术的本义 ,也基于新时期的现实需要 ,更是我国法律制度创新对法学理论创新的需求 ,同时 ,也是当前校正学术领域消极支流的实际需要。但对原创性准则的内涵尚缺乏具体界定 ,因而存在诸多误识 ,直接影响学术成果的质量。对原创性准则进行探讨并作出科学界定 ,期以建立起准确共识 ,是繁荣、发展学术研究的当务之急。

The creativeness principle is the basic principle of scientific research. It roots in the original meaning of academy and it is based on the requirements of the reality in the new era as well. It is exactly the requirement for creating the theories of jurisprudence in correspondence to creating the legal system of China. At the same time, it is also a pressing task to eliminate the negative factors in the academic field. However, the connotation of creativeness criterion has not been concretely defined. Therefore, there are a lot of misunderstandings which directly affect the quality of academic fruits. In order to have a scientific common understanding, discussion and scientific definition of the creativeness criterion are the urgent affairs for booming the academic research.
