摘要
《民法通则》明确把公平原则作为我国民法的基本原则,但公平原则是否仅为一项归责原则、我国民法 承认公平原则的理论依据是什么、公平原则到底具有什么功能等一系列问题,仍需要继续探讨。
Our state civil law regards fair principle as basic principle. But whether it is only a responsibility principle, what is the theory basic of fair principle, what is the function of fair principle, and so on, still need further researching.
