论民事诉讼检察监督的范围

On the Extent of Procuratorial Supervisor in Civil Proceedings

我国民事诉讼法确立的检察监督范围仅限于人民法院的生效裁判 ,限制了检察监督权的行使 ,也不能适应时代的要求 ,必须进行立法完善。检察机关应有权对所有诉讼主体进行监督 ,对整个诉讼程序进行监督 ,对法院不作为违法行为进行监督。但监督范围的扩大着重点应在于检察监督“预控力”的扩大 ,而不意味着检察机关必须参与大量的民事诉讼。

The extent of the Prosecutorial supervision established by the Civil Procedure Law is confined only to the effective judgments made by the courts,which has restricted the exercising of prosecutorial supervision power.This obviously cannot meet the demands of a rapidly progressive era and therefore should be reformed.This author suggests that the procuratorates have the right to exercise its supervisory power on all participants in a civil porceeding and the whole porceeding itself as well,and on the illegal omissions of the courts.However,the author points out further that such extendment should focus on the 'pre control power' rather than on participating mass civil cases.
