传承与超越:现代化视野中的中国刑法传统考察

现代化的普适性和扩张性 ,决定了其在本质上反映的是文明的属性 ,代表着历史发展潮流的共性以及人类社会的普遍出路。文明虽然可以相互借鉴和移植 ,但作为文明精神底蕴的文化却只孕育于本国的传统土壤之中。古老的中华法律文明在留给我们灿烂的刑法制度传统的同时 ,也给我们留下了大量有悖于现代刑法文明的观念传统。因而传承刑法制度传统和超越刑法观念传统的并行不悖 ,决定了中国刑法传统在现代化进程中的走向。为此 ,我们需要对中国刑法传统的现代价值进行认真的检视和转换性创造。

The universality and expansion of modernization decides what it reflects in nature is the attribute of civilization and represents the general character of history development trend and the way out for human society. Although civilizations can be borrowed for reference by one another and transplanted, culture which serves as the inside information of civilization spirits can only be given birth in the traditional soil of its native country. The ancient Chinese legal culture leaves us not only the splendid criminal law system traditions but also a lot of mentality traditions that are against modern criminal law civilization. Therefore, inheriting the criminal law system traditions and exceeding criminal law mentality traditions are not mutually exclusive. This determined the alignment of the Chinese criminal law tradition in the process of modernization. So we need to make a close investigation and transitional creation to the modern value of Chinese criminal law tradition.
