犯罪学与刑法学的关系——兼谈犯罪学的性质与特点

犯罪学与刑法学互为亲缘学科 ,但二者之间并非简单的“母子关系”或派生与被派生的关系 ,而是有着一定亲缘联系的共生关系。按学科属性归类 ,犯罪学属于行为科学 ;按学科功能归类 ,犯罪学可以归于刑事科学。通过对犯罪学的实证研究 ,对犯罪可以获得本体性和规律性的认识 ,对刑事立法和刑事司法具有指导意义 ,因此 ,犯罪学不是刑法学的辅助学科。犯罪学与刑法学的发展 ,需要二者的结盟。

Criminology and criminal jurisprudence are the disciplines with affinity. However, they are not in the simple 'mother-son relation' or the relation between a deriving discipline and a derived discipline. They are in an intergrowth relationship which has certain affinitive relations. Pursuant to the category of discipline characters, criminology is subject to the science of conduct. According to the category of discipline functions, criminology can be included in criminal science. Through the positive study on criminology, the cognition of noumenon and regularity can be obtained about crimes. The study has guiding effect on criminal legislation and criminal judicature. Therefore, criminology is not an auxiliary discipline of criminal jurisprudence. The development of criminology and criminal jurisprudence needs the unification of the two disciplines.
