摘要
特别权力关系是指具有某种职务的人 (如公务员 )与国家统治权之间的法律关系。处于此种关系中的相对人之权益受到侵害时能否提起行政诉讼 ,存在不同观点。目前 ,德国、日本对于特别权力关系理论作了修正 ,更强调相对人的权利保障 ,值得我们借签。
Special power relation refers to the legal relationship between people in certain posts (e.g. civil servants) and state sovereignty. Controversies exist about whether administrative actions can be instituted when the rights and interests of the counterpart involved in such relationship are invaded. At present, Germany and Japan have made amendments to the theory of special power relation, which emphasize the guarantee for counterparts, and worth our borrowing for reference.
