走私、贩卖、运输、制造毒品罪形态研究

Study on the Forms of Smuggling, Trafficing, Transporting and Making Drugs

对走私、贩卖、运输、制造毒品犯罪形态的研究,目前仍处于理论上莫衷一是、实践中五花八门的状态。形态关乎量刑,形态标准关系着刑法正义价值的实现。学术对话需要共同的语境和学术方法。在毒品犯罪形态的分析上,这种共同的语境和方法是客观存在的,第一是汉语言的标准;第二是刑法总则与分则的规定;第三是应用法学或注释法学必须采用的形式逻辑分析。刑法没有将牟利作为走私、贩卖、运输、制造毒品罪的犯罪目的,那么,判断这些犯罪的得逞与否,就不应以是否达到牟利目的为标准。正是基于上述认识,笔者提出了判断走私、贩卖、运输、制造毒品罪的既遂、未遂标准。

The research situation on the formations of smuggle, traffic, transport and drug-making offences is dissatisfied now, it is unable to agree or decide which is right in theory, it is also full of multicolored in practice. The formation is important for measurement of penalty. The formational standards is also an essential factor for the reality of criminal justice. To analysis on the formations of drug crimes, there are common discourse, semantics and methods objectively in doing this research. Firstly, the standards of Chinese language, secondly, the regulation of general provisions and subdivision of criminal law, thirdly, the necessary logical analysis of applied jurisprudence. This article suggests some new standards by which we can determine the accomplished offence and the attemped offence of drug crimes.
