摘要
从经济学的角度分析法治、人治各自存在的客观条件,并用法律经济学分析的方法,分析了不同经济条件下,社会该如何选择法治和人治。这种分析不仅会开拓我们视野,使得我们对当代中国社会主义法治的逐渐形成有一个更为务实的态度,而且可能使我们在实践中对法治和人治都获得一种更深刻的认识。
From the perspective of economy,this paper analyzes the objective existent conditions for ruling by the law and ruling by man.By way of the analytic approaches of law economy,this paper expounds how the society should choose between ruling by the law and ruling by man in different economic conditions.Such analysis can not only widen our vision to let us have a more realistic attitude toward the socialistic ruling by the law in modern China,but also bring us to a more profound understanding of ruling by the law and ruling by man in practice.
