摘要
历史主义的法律移植研究存在着基本缺陷。本文提出 ,为了更好地展开法律移植实践 ,深入理解法律移植的实质也即廓清“法律移植与广义‘立法’活动是同质的” ,非常必要。以此为基础 ,本文认为 ,从“法律与政治”的应然关系入手 ,在“当下”社会共识的建立中寻找、追求 ,是解决法律移植问题的一个新的重要路径。
The historicist approach in work on legal transplantation is fundamentally inadequate. It is essential to understand that legal transplantation is a form of law-making in a broad sense. Only with such an understanding can we properly transplant laws with a clear view about the process. This being the case, work on 'building an immediate social consensus' on the basis of the inevitable relationship between law and politics is an important new solution to these issues.
