摘要
船员的社会保障一直是国际劳工组织所关注的问题 ,但各国法律实践的不同和船员职业极具流动性的特点 ,给船员社会保障全球化实现带来了许多障碍。在外国旗船上工作的船员 ,可能没有资格受到船旗国社会保障制度的保护 ,而其居住国或国籍国可能也不能提供社会保障的保护。本文通过引据《1982年联合国海洋法公约》的有关条款和借鉴国际劳工组织在修订《综合海事劳动条约》过程中的讨论 。
The social security protection of the seafarers has been addressed by the International Labour Organization over a long period of time. However, there are tremendous obstacles upon the seafarers' social security protection realized globally, not only because of the differential judicial practice provided by the national security systems,but also the mobilized feature of the seafarer. Seafarers working on foreign flag ships may not be eligible for protection under the social security system of the flag state and whose country of residence or nationality may also not provide social security protection. This paper tries to discuss the Nation's role and status on the realizing the social security protection of the seafarers.
