近年来,我国农民合作运动飞速复兴,因缺乏法律制度保障而难于健康发展。本文在吸收我国经济学界、社会学界有关农民合作问题最新研究成果的基础上,考察了国外有关农业合作社的立法实践及其发展趋势,结合我国农业合作社的发展现状,对我国农业合作社的法律问题进行了系统研究。旨在引起法学界对此问题的关注,以期为急需创设的农业合作社法提供相应的理论资源。

China's peasants' cooperating movement has revived quickly in recent years, and due to the want of legal protection it is difficult to develop healthily. This article absorbs the late economical and sociological research fruits on this issues and makes a survey of foreign legislations on agricultural cooperates, aims to arouse the attention of legal circle and provide theoretical resource to the legislation of agricultural cooperates.
