法学知识的现状偏差——以麻风病作为切入点

The Warp of the Knowledge of Law in the Status Quo:By the Mirror of Leprosy

作为法学知识与法学外部知识互动的一个案例 ,这篇论文考察了麻风病在当代中国婚姻法学变迁的形象和特点 ,这一方面折射出当代中国法学的发展和法学与外部学科知识交流中存在的问题 ,同时从一个方面说明了法学知识的保守特征。从认知心理学的现状偏差 ,和法学职业实践知识的角度 ,文章对这种保守的特征进行了更深入的分析。

As a case showing the interaction between the knowledge of law and the knowledge of other disciplines, this article reviews the image and characteristics of Leprosy in the change of modern Chinese marriage law, which on the one hand reflexes the problems lying in the development of modern Chinese law and its communication with other disciplines, on the other hand indicates the conservative character of the knowledge of law. From the point of the warps of cog-psychology in the status quo and the professional practical knowledge of law, this article makes further deep analysis on its conservative character.
