The Distinction between “Jus” and “Law” and the Interpretation of Civil Law

法是调整社会关系的应有规则 ,存在于社会中。法律是将法成文化。法是解释法律的依据。民法解释必须审查其合法性 ,民法对特殊情况是否适用 ,也应以法为依据。在没有民法规定的情况下 ,法是解决问题的直接依据。

Jus exists in society, which is the implicit law in the most abstract and general sense used to regulate social relationship. Law literally expresses jus, but must be interpreted in accordance with the spirit of jus. Therefore, the interpretation of civil law should be examined to ascertain it to comply with jus civil. Moreover, if civil law is applied to some special cases, such application should comply with jus civil. Where the provision of civil law cannot be found, the relevant interpretation should be directly on the basis of jus civil.
