非法经营罪是97年刑法修订后变化最多的罪名,也是最难准确理解、适用的罪名之一。本文从非法经营罪的 立法缺陷和司法操作方面对非法经营罪的有关问题进行了探讨,指出了司法操作以及立法中应注意的问题。

The crime of illegal business is the one of the crimes that changed fastest since Criminal Law has been amended since 1997 and it is also more difficult to understand and use. This paper will probe into some judicial and legislative flaws of this crime and point out the problems that should be paid attention to.
