摘要
现行刑法中非法采矿罪在立法技术、罪名、构成要件以及刑事责任方面还存在诸多缺陷,不利于指导司法实践。本文对非法采矿罪存在的缺陷进行逐一剖析,并提出了相应的完善措施。
In the present criminal law, there still exist a great lot of defects in legislative technology, charge, construction of crime and criminal liability for the crime of illegal mining, so it is not favorable to instructing the administration of justice to take practice. This text analyses these defects one by one, and puts forward the corresponding perfection measures.
