The Criterion of America and EU Determining the Normal Value of the Export Products from Non-market Economy Countries

WTO《反倾销协议》规定熏在进行如反倾销协议确定的比较价格可能存在特殊困难熏可以使用替代国的价格。美国、欧盟在进行反倾销调查时,往往不承认中国的市场经济状况,运用非市场经济和替代国的方法对待中国出口产品正常价值的认定。本文拟就美国、欧盟反倾销法对非市场经济国家产品正常价值的确定标准进行探析,以加深我们对美国、欧盟反倾销法规则的理解和掌握。在此基础上,提出我国应对美国、欧盟对我国进行的反倾销调查的策略。

The Agreement on Anti-dumping of WTO stipulates: In the case of imports from a country which has a complete or substantially complete monopoly of its trade and where all domestic prices are fixed by the State, special difficulties may exist in determining price comparability. Then it can be determined by the alternative country's domestic price. When America and EU carry out antidumping investigations against China, they often don't acknowledge the market economy status of China. This article examines the criterion of America and EU which determine the normal value of the export products from non-market economy countries. This will be in favor of our understanding and grasping the anti-dumping rule of America and EU. On this basis, the strategy which we develop to face the investigations of America and EU will be given.
