论建设工程合同的法律属性

On the Legal Properties of Construction Project Contracts

我国《合同法》第十六章专章对建设工程合同进行了规定，由此可见，一般来讲建设工程合同属于民事合同。文章着重从行政法角度论述了建设工程合同的行政合同属性，并指出认清此点具有十分重要的现实意义。

The 16th Chapter of our country's Contract Law is specially devoted to the regulation of construction project contracts, hence we can deduce that construction project contracts are of a civil nature. From the administrative law point of view, this paper probes into the legal properties of construction project contracts as some type of administrative contracts.
