经济法的基本原则是经济法规所体现的具有普遍意义的指导原理,是经济规律与法律科学结合的具体体现。在我国建立社会主义市场经济制度过程中,确立经济法的基本原则,对健全经济法律体系具有重要的基础作用。随着我国加入世贸组织,社会主义市场经济的发展也必将融入世界经济体系。我国经济法的基本原则不仅要反映社会主义市场经济法的本质特征,还要体现我国信守对世贸组织的承诺,经济法的基本原则也应随之注入新的内容。
