知识产权立法体例与民法典编纂

近代民法典的结构是在罗马法体系基础上的改造 ,知识产权立法与近代民法典未能发生历史的机缘 ;现代民法典编纂运动尝试接纳知识产权制度 ,但至今尚无成功的立法例。当代知识产权法是一个综合性、开放式且最具创新活力的法律规范体系 ,不宜将其全部植入民法典。我国知识产权制度宜在民法典中作原则规定 ,但同时保留民事特别法的体例。

The structure of modern civil code is based on Roman legal system, and excludes intellectual property law. The current movement of civil legal codification has tried to include intellectual property law in it, but has not succeeded yet. Current intellectual property law is a comprehensive, open and creative system, so it should not be input into civil code. China's intellectual property law should be stipulated in civil code in principle and at the same time maintains it's civil special law's status.
