对民法占有制度的几点思考

当代社会的财产问题,事实上已集中表现为财产归属和财产利用这样两个相对独立的方面.中国的物权制度应当体现这两种基本经济活动的性质和相互关系,从而客观地反映当代中国的财产关系.尤其是应有一套适合时代要求的财产利用制度,即由占有权制度反映和调整占有人与一切非占有人尤其是所有人之间的关系.

The problem of property in current society has actually epitomized in two relatively independent aspects: property's ownership and utilization, therefore, the Chinese system of real right should embody the nature of the two basic economic activities and their relationship, thereby objectively reflecting the property relationship in current society of China. It is particularly important to establish the system of property utilization which meets the requirement of the times to reflect and adjust the relations between property occupiers and non-occupiers, especially the property owners.
