农地使用权流转的有关法律问题

我国现行农地制度存在诸多阻碍农地使用权流转的因素,但从我国现实来看,农地使用权流转制度有其存在的基础.根据我国多年的实践和国外土地流转经验,可将我国农地使用权的流转方式确定为出租、抵押、转包、转让和入股,但须在某些方面作出限制.

Although there're many factors which hinder the change of farmland usufruct in the current farmland system of China, the system has its existent basis in the reality of our country. According to the long-term practice in China and the experience in change of farmland usufruct, the change ways can be classified into renting, sub-contracting,mortgage, transfer and buying a share, but restrietion should be placed on some aspects.
