行政法律语病例析

An Analysis of Ungrammatical or Ill-formed Sentences in the Texts of Administrative Laws and Suggestions for Revision

九十年代以来 ,我国先后颁布实施了四部规范政府行为的行政法律。它们的实施不仅对保护公民、法人和其他组织的合法权益 ,而且对促进依法治国、依法行政都有重要意义。但是这四部法律的某些条款由于语言表达上不够规范 ,某种程度上影响对法律的正确理解和实施。本文拟对这四部法律中的部分语病分类作一些解析 ,以提高我国的立法水平 ,推进我国依法治国的进程。

Four administrative laws in strengthening construction of administrative organization have been issued by legislative departments in China since the 1990s. To enforce these laws is highly important, not only in the sense that it can protect the citizens, the legal persons and non legal person organizations from illegal acts, but also in the sense that it can also promote the process of ruling state by law and administration by law. But there are certain inadequacies of the language expressions in the texts of some of the laws, which, to some extent, affect the accuracy and enforcement of the laws. This paper is intended to make an analysis of such ungrammatical or ill formed sentences. It is our purpose to improve the quality of the legislation and to promote the process of ruling state by law.
