《旅游法》立法初探

文章通过与发达旅游国家旅游基本法的论述和比较 ,阐述我国旅游基本法所应具备的内容 ,建议通过重点解决两方面问题来解决我国如今所面临的旅游基本法的立法障碍 ,一是明确旅游法律关系主体之一的旅游行政主管部门定位与指向 ;二是重点突出保护旅游消费者的合法权益。

Comparing with the tourism laws of the developed countries,the necessary contents of China's law of tourism are illustrated in this paper. The author suggests we should carry out two basic approaches to solve the problems that preventing the law coming on. One is to give the Tourism Administrative Department orientation; the other is to emphatically protect the tourist's lawful rights.
