从依法行政看公安行政执法监督

Viewed the Police Administrative Execution Supervision through the Rule of Law

我国正式成为WTO成员,以及《行政许可法》的颁布实施,对我国行政管理体制产生重要影响,特别是对依法行政工作提出更高的要求,其中对公安行政执法的要求更为严格。依法行政中"行政"的关键是行政执法,行政执法的重中之重应该是公安行政执法。本文拟从依法行政与"以法行政"这对概念的解释入手,通过对实践中公安工作误区的分析,阐明建立完备的公安行政执法监督制约机制的重要性。

Becoming the formal member of WTO and the carrying out of 'administrative admission law' brought great influence to the chain of command in our country, especially put forward higher requirement to the work of the rule of law, in which the police administrative execution was much more demanded. The key of the 'law' in 'rule of law' is administrative execution whose emphasis should be the police administrative execution. This paper began with the explanation of the concept of 'rule of law' and 'rule by law', through the analysis of the mistakes of police works, illuminated essentiality of establishing an integrate police administrative execution supervision system.
