辩诉交易是源于美国的一项简易诉讼程序,近年来迅速发展并越出英美法系进入大陆法系,成为一项世界性的简易诉讼程序。从辩诉交易的生产和发展入手,以理性分析的独特视角,就辩诉交易的内在价值和外在环境两个主要方面做了较为深入的分析,以期时我国的简易程序完善和建设有所帮助。

Plea bargaining, a simplified lawsuit procedure, originated from the U. S. However, it has been developing beyond the boundaries of the Anglo - American Law System and into the Continental Law System, thus becomes a worldwide simplified lawsuit procedure. In order to help the perfection and construction of China law system, the author analyzes the origination and development and discusses the inner values and outer conditions of the plea bargaining.
