摘要
本文认为 ,长三角的经济一体化需要法制的保障。要建立适应长三角经济一体化的法制平台 ,我们必须以长三角经济一体化 ,行政区划和利益主体不变 ,以及中央和地方的职责分工为前提。基于这一前提 ,国家的统一法制对长三角经济一体化的保障是不充分的 ,谋求长三角地区的统一法制是不现实的 ,而只能谋求地区性多元法制的协调。协调多元法制的机制 ,实践中已经探索出行政契约制度和磋商沟通机制 ,理论上也提出了各种方案。但本文认为 ,不断强化和完善行政契约制度和磋商沟通机制 ,充分发挥其功能 。
The economic integration of Yangtze River Delta needs the safeguard of legal systems. To build up a suitable legal platform for the economic integration of Yangtze River Delta,we must act on the presupposition that the economic integration,administrative division and interests subjects remain unaltered,and that there must be a responsibility division between the central and local government. However it’s insufficient for the nation’s integrated legal systems to guarantee the economic integration of Yangtze River Delta,and it’s unrealistic to seek the integrated legal systems in this area. Our only way out is to adopt a coordinate system of regional diversified legal systems. Such coordinate systems have been established in practice. Administrative contracts and the consulting & communicating system are two examples. There are also other proposals,but we believe that continuously strengthening and perfecting administrative contracts and the consulting & communicating system,and making full use of them,are the inevitable choice to further push forward the economic integration of Yangtze River Delta.
