中国科学院新院章制定的法律背景研究

The juristic study on the coming new charter of Chinese Academy of Sciences

本文围绕中国科学院制定新院章的两个基本的法律问题 ,即中国科学院的法律地位问题和新院章制定的有关法律依据问题 ,分别从国际背景、历史情况以及当前现状三个方面进行了较为深入地分析和探讨 ,得出相关的研究结论并提出参考建议。

As a basic juristic study to the coming new charter of Chinese Academy of Sciences(CAS), this paper deals with two topics: the law status of CAS and the law source of the new charter of CAS, which are discussed from three aspects separately, one is from international background, one is from historical perspective, the other is from current evaluation of CAS. On the basis of analysis the paper gives some conclusions and useful suggestions.
