摘要
随着我国经济的快速发展以及工业化和城市化进程的加快 ,建设用地的需求旺盛 ,致使政府土地征用权的频繁行使。土地征用是地权行政的内容 ,我国现行的土地征用都是国家行为。但是 ,现行的土地征用制度带有强烈的计划经济色彩 ,暴露出一系列缺陷 ,由此诱发了大量的矛盾。征地工作事关国家经济建设 ,涉及土地权益、农民的切身利益和社会稳定。确立征地补偿的市场取向 ,建立和完善适应市场经济的征地制度势在必行。
With the speedy development of China's economy and the acceleration of industrialization and urbanization, the requirement for land used in construction becomes brisk, and this leads to the government's frequent use of eminent domain. Transformation of economic institution is accompanying the process and the basic economic characteristics of the transformation are diversity of economic relationships, duality of price system and localization of economic promotion system. The requisition of land is the content of easement administration and all present requisitions of land in China are state activity. However, the present system of requisitions of land has strong character of planned economy, and the system has revealed a series of shortcomings and thus caused big amount of problems. The work of expropriating land is closely connected with the State's economic development and involves land right, peasants' immediate interests and social stability. Accordingly, it's a tendency to establish market-orientation system for compensation for removal due to requisition of land and to establish and perfect the requisition of land system, which is suitable for market economy.
