建立健全高教拨款中介组织的法学视角——从“拨款委员会”到“高教基金会”的法学透析

On Law Standpoint of Establishing and Perfecting the Appropriation Intermediary in Higher Education ——from “UGC”to “HEFC”

英国大学拨款委员会 (UGC)是一个由政府部门发起并给予财政拨款 ,主要通过资金划拨、审议、咨询、评估等手段干预大学办学的中介机构。很长时间以来 ,这种由“大学拨款委员会”这一政府与大学之间的“缓衡”机构来分配教育经费的方式 ,既保证了国家对高等教育的投资 ,又保持了高等学校的自治特征。从法学的角度来透析该高等教育中介组织与政府之间关系的嬗变 ,可以发现 :保证中介组织的合法性 ,让它具有和政府、和高校讨价还价的资本和地位 ,保证它能够做出自己的独立的既不偏向政府 ,也不过分偏袒高校的判断和决定 ,这样才能让它更有效地为政府和高等教育服务。

As an intermediary,which is sponsored by the goverment,UGC has influenced univer sities,especially their ways of running school,by means of appropriation,discuss ion,consultation and evaluation.For a long time,UGC,not only ensures the investm ent of nation in higher e ducation,but also help to remain autonomy of universities.After analyzing the ch anges of relationship between higher education intermediary and government from the p erspective of law,it is found that the legality of intermediary should be g uaranteed so tha t it is on equal terms with government and universities,and make its own decisio n independently.Eventually it can serve the government and ihgher education more efficiently.
