论现代劳动法的基本理念

On the Fundamental Propositions of Modern Labor Law

现代劳动法体系必须建立在现代劳动法问题基本理念的基础上,现代市场经济国家处理劳工问题普遍遵循 “劳工不是商品”、“三方主体结构”和“社会进步成果分享”三大理念。我国的劳动法现代化是建立在现代市场经济 基础之上、按现代市场经济规则办事的,因而这些理念也应成为我国劳动法的基本理念。

Labor relations in modern market economies are dedicated with these fundamental propositions, which are 'labor is not a commodity', 'tripartite structure of labor law subjects' and 'everyone can share the fruit of Social progress and social prosperity' . Whereas China is taking a market economy, we comply with the rules of modern market economies in the world, thus the three propositions should be taken as fundamental views by China's labor law system.
