制度与德性的融合:当代中国的廉政建设模式

The Mixture of System and Virtue:the model of anti-corruption construction in contemporary China

以法治腐是廉政建设的基本模式 ,但法律自身无法克服的局限性使得以法治腐也是力不从心 ;中国古代倡导以德养廉 ,但也因道德过分相信“自律”而无法扼制中国几千年的制度性腐败 ;只有德法并举 ,建立起“制度———规范———德性”三维一体的治理模式 ,才可能有效地进行廉政建设 ,这也是“依法治国”与“以德治国”相结合的必然要求。

The model of lawful anti corruption is the principal one of the anti corruption construction.However,the limitation that law itself can not overcome makes it difficult to be against corruption.Ancient China advocated that moral could bring up honesty.But it could not snuff out the corruption of China which had a long history of several thousand years because it extremely depended on self restrict.Only by the means of the mixture of moral and law as well as the unification of system,regulation and virtue,can we effectively carry out the plan of anti corruption construction,which is also the essential requirement of the unification of rule of moral and rule of law.
