魁北克国际私法立法述评——兼论其对中国国际私法立法之借鉴

Evaluation on Quebec Private International Law Legislation

魁北克现行国际私法立法重视"魁北克传统、经济利益和社会利益以及全球性国际私法的统一化运动",魁北克立法者严谨务实的立法态度、结构严谨的立法体例和省际法律冲突等同于国际法律冲突的立法规定等三个方面对中国国际私法立法有一定启示与借鉴意义。

This paper introduces the historical background, main contents, legal sources and advantages of Volume Ten of Quebec Civil Code on Private International Law, then probes into the emphasis of the orientation and several guiding principles of 'Quebec traditions, economic and social interests as well as global unification movement of private international law'of the present private international law in Quebec, and finally examines the significance of the above legislation on China's legislation of private international law from three points, i. e. , the practical attitude of legislation of Quebec legislators, the integrity of the form of legislation and provisions on inter-provincial conflict of laws equivalent to international conflict of laws.
