摘要
陈亮继承和发展了礼法结合的思想 ,又认为礼法交修 ,以仁为本 ,归于王道 ;继承和发展了明德慎罚的理念 ,又主张简法轻刑 ,反对严刑峻法 ,追求公正 ,崇尚德治 ;继承和发展了儒法入世法治的精神 ,又强调法制的经世致用 ,因时变通。他剖析人本、社会、变革以及实事、功用、变通 。
Chen Liang developed the idea of combining etiquette and law with benevolence as the base and with the benevolent government as the end. He developed the idea of virtue and prudence in punishment, valuing justice and government by virtue and opposing to cruel torture. He developed the idea of Confucianist and legal government, and stressed the functions of legal system and its efficiency in social development. Through analyzing human-centered spirit, society, transformation, utility and adaptation, he formed the legal thoughts with the characteristics of his own and his age in dialectical materialism.
