摘要
辞职权是劳动者的一项基本权利。根据不同的标准可将辞职权分为法定辞职权与约定辞职权,有条件辞职权与无条件辞职权等,其中约定辞职权存在有一定的合理性。无条件辞职权的设置对于保护弱者,优化资源配置等方面有着积极的意义。依法行使辞职权不应承担违约责任。
The right of resignation is one of the fundamental rights of the labore r.We can classifies the right of resignation in different ways according to diff erent standards,such as the right of resignation in accordance with the law or t he will,the right of resignation with or without preconditions.The existence of the right of resignation without preconditions has its positive meaning,the same as the existence of the right of resignation without preconditions,which can su rely protect the weak and well dispose the resources.The laborer should not be r esponsible for breaking a contract when he resign in a lawful way.
